SCOPE OF AGREEMENT
The Scope of this Agreement clarifies overall participation for the ONEderWorld Arts Festival at the Music City Mall. This agreement is for the purpose of clarity and safety. On the days of January 22nd - 25th
RULES, TERMS AND CONDITIONS OF PARTICIPATION
I have read and understand the rules, terms and conditions of participation in the ODW Festival at the MCML (and have explained them to my minor participant if applicable) and will comply with them at all times. Management and/or professional staff at their sole discretion may terminate my participation at any time if I fail to abide by rules terms and conditions. Management and /or professional guides preserve the right to modify or cancel any activities due to unfavorable conditions or conflicts.
I will wear my mask at all times with the exception of consuming nutrition. I will respect everyone’s space, maintaining a 6ft apart distance. I will be courteous and respectful to my surroundings. I understand that any misconduct is grounds for removal from ODW.
I understand that I am responsible for my own breaks, belongings, and overall health.
I comprehend and appreciate that there are foreseeable, unforeseeable and inherent dangers and risk of harm involved in some of the sport activities offered at ODW. I acknowledge that the activities can be physically and mentally intense. I know and understand that the risk of injury from activities is significant, I acknowledge there is a risk that my personal property including clothing jewelry equipment and the like can be lost, damaged or destroyed.
LIABILITY WAIVER AND RELEASE OF CLAIMS
I acknowledge that I derive personal satisfaction and a benefit by virtue of my participation and/or voluntarism with ODW, and I willingly engage in ODW events and/or other fundraising activities (the “Activity”).
ASSUMPTION OF THE RISK. I acknowledge and understand the following:
I/we agree to release and hold harmless ODW at MCML including its teachers, staff members, and facilities used by participants from any cause of action, claims, or demands now and in the future.
Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist;
I knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID-19, even if arising from the negligence or fault of the Released Parties; and
I hereby knowingly assume the risk of injury, harm and loss associated with the Activity, including any injury, harm and loss caused by the negligence, fault or conduct of any kind on the part of the Released Parties.
COMMUNICATIONS
I will communicate clearly to event staff if there is anything affecting my safety or the safety of others/to the property. I understand any disagreements must be made clear with a reasonable solution. Complaints should be within reason based strictly on safety, business effectiveness, and integrity. in the event of a disagreement, I will communicate in a respectful manner and the ODW at MCM leadership will choose a diplomatic solution towards maintaining a peaceful work environment for everyone.
MEDIA RELEASE
I understand ODW is a public event with live media collection and by being present I hereby grant ODW and person acting for or through it have the right to edit videos photographs and sound recordings of myself/my child and/or use details from my submission for use in marketing or promotional materials they may create without compensation or permission to use media with myself/my child.
I fully and irrevocably release and hold harmless ODW and its agents from all liability loss claims, demand, and actions arising directly or indirectly out of the use of pictures or the recordings of my image or voice, if applicable, for marketing purposes.
CONCLUSION
Media signage is clear for the general public any purchase within the ODW organization website/onsite ticketing/classes is an acknowledgement this agreement was read and acknowledged.
